依法治军、从严治军
依法治军、从严治军不是单纯的依法管理,而是依法建设、治理和运用军队。2014年10月举行的中共十八届四中全会,首次将依法治军、从严治军纳入依法治国总体布局,实现了人民解放军法治建设的历史性飞越,是依法治国方略在军事领域的具体运用。2015年2月,中央军委印发《关于新形势下深入推进依法治军从严治军的决定》,对依法治军、从严治军作出全面部署。依法治军、从严治军的本质要求是法规至上,它要求人民解放军强化法治信仰和法治思维,构建完善中国特色军事法治体系,形成系统完备、严密高效的军事法规制度体系、军事法治实施体系、军事法治监督体系、军事法治保障体系,按照法治要求转变治军方式,形成党委依法决策、机关依法指导、部队依法行动、官兵依法履职的局面,不断提高国防和军队建设法治化水平。

Law-based governance of the military and strict enforcement of discipline are not simply a management issue; they cover every aspect of China's efforts to build a strong military.
This initiative was unveiled at the fourth plenary session of the 18th CPC Central Committee in October 2014, as part of an overall strategy to promote the rule of law nationwide. The move, as mandated by a Central Military Commission decision in February 2015, represents a milestone in the development of China's military judicial system.
It calls for respect for the supremacy of the law and heightened awareness of the importance of the rule of law, and promotes law-abiding practices within the armed forces. It envisions a distinctively Chinese military judicial system that ensures rigorous and efficient enforcement of military laws and regulations through effective implementation mechanisms, accompanied by effective oversight and institutional guarantees. A paradigm shift is required to ensure that the law is respected in all decision-making processes of Party committees, administrative offices and command centers, and in the execution of duties by all military personnel.
